Is it possible to write a Finder script
that works with both OS9 and OSX?
The script should not ask the user
to locate Finder.app when it runs.

I know how to do this with other applications
with "using terms from". However, Finder
is not considered a real application by
the Mac OS.

Just leave off the ".app" from the script.

But be aware that if the script is running under OS9 then there might
not be any file called 'Finder.app'.
