When I open a stack with the shift key down,
it opens in a new window.

Is there a way to avoid this behaviour?

Hi Sylvain,

This seems like normal behaviour to me. Regardless of whether
the shift key is pressed, a stack opens in a new window, if the
stack has been double-clicked on in the Finder.

If youo don't want this, you probably need to write a script
which closes all other stacks if the shiftkey is down. This
would be fine if it is a project for personal use, but I
wouldn't recommend it if you are going to make it available to
others.
